Terms of Sale (TOS)

1. Purpose

These Terms of Sale (CGV) govern the contractual relationship between OCTOREALITY SARL, hereinafter referred to as "OCTOREALITY", and any business or individual customer using the WeGuests guest management platform.

The WeGuests platform enables guest list management, electronic invitation sending, RSVP collection, individual QR code generation, invitation status tracking, and guest access control and check-in at events.

Any order placed on the platform implies full and unreserved acceptance of these Terms of Sale.

2. Company identification

The WeGuests platform and services are operated by:

3. Description of services

Through the WeGuests platform, OCTOREALITY sells event credits allowing customers to create and manage events.

Depending on the subscribed offer, credits provide access to different service levels, including:

  • Guest management;
  • Electronic invitation sending;
  • RSVP management;
  • QR code generation;
  • Mobile check-in application;
  • Tracking dashboard;
  • Online registration forms;
  • Additional services offered by WeGuests.

The specific features of each offer are those published on the website at the time of purchase.

4. Order and purchase of credits

The customer purchases event credits to use the WeGuests platform.

Each credit is associated with a specific offer (Basic, Plus, Pro, Enterprise, or any future designation).

The purchase becomes final after payment validation.

WeGuests reserves the right to refuse or cancel any order in case of fraud, attempted fraud, or non-compliance with these Terms of Sale.

5. Credit validity period

Purchased event credits are valid for twenty-four (24) months from the date of purchase.

Upon expiration, unused credits automatically lapse and can no longer be used.

Expired credits are not eligible for any refund, compensation, or indemnification.

The customer may submit an exceptional extension request to WeGuests before the expiration date. Any extension remains at WeGuests' sole discretion and does not constitute an acquired right.

6. Pricing

Service prices are indicated in Tunisian dinars (TND).

WeGuests reserves the right to modify its rates at any time. Services are billed based on the rates in effect at the time of order.

7. Payment terms

Payments are made exclusively online by bank card.

Accepted payment methods include:

  • Visa
  • Mastercard
  • CIB

No payment by bank transfer, check, or cash is accepted through the platform.

Payment is due immediately upon ordering.

8. Refund policy

Any validated and paid order is considered firm and final.

Purchased event credits are neither refundable nor exchangeable.

No refund will be granted for total or partial non-use of purchased credits.

9. Customer responsibilities

The customer remains solely responsible for:

  • The accuracy of information imported into the platform;
  • The quality and updating of their guest list;
  • Compliance with applicable personal data protection laws;
  • The lawful collection of email addresses and other personal data used;
  • Obtaining necessary consents when required by applicable regulations.

The customer guarantees that they have all necessary rights and authorizations to process guest data imported into the platform.

The customer agrees not to use WeGuests services for unlawful, fraudulent purposes or purposes contrary to good electronic communication practices.

10. Limitation of liability

WeGuests acts exclusively as a technical tool for guest management and event-related communications.

WeGuests shall not be held liable for:

  • The content of invitations created by the customer;
  • The legality of imported data;
  • Errors in guest lists;
  • Refusals, filtering, or blocking by third-party email providers;
  • Consequences related to misuse of the platform.

WeGuests' liability is strictly limited to the amount actually paid by the customer for the credit concerned.

11. Service availability

WeGuests uses all reasonable means to ensure platform availability.

However, WeGuests does not guarantee uninterrupted service and may perform maintenance, updates, or improvements without prior notice.

12. Intellectual property

All elements comprising the WeGuests platform, including software, interfaces, trademarks, logos, texts, graphics, and databases, remain the exclusive property of WeGuests SARL.

Any unauthorized reproduction, modification, distribution, or exploitation is prohibited.

13. Data protection

WeGuests commits to implementing reasonable technical and organizational measures to protect data processed through the platform.

The customer remains responsible for complying with their own legal obligations regarding the collection and processing of their guests' personal data.

14. Modification of Terms of Sale

WeGuests reserves the right to modify these Terms of Sale at any time.

New conditions take effect upon publication on the WeGuests website.

15. Applicable law and jurisdiction

These Terms of Sale are governed by Tunisian law.

Any dispute relating to their interpretation, execution, or validity shall fall under the exclusive jurisdiction of the territorially competent Tunisian courts.
